ShopStyle Inc. dba Collective Voice ("Collective Voice," "we," "us," "our") operates a creator network program that makes available certain websites (including www.collectivevoice.com), tools, applications to enable content creators to promote and monetize certain content ("Program"). This Privacy Policy describes Collective Voice uses, shares, and protects information it may collect through the Program. If you are a registered Collective Voice creator ("Creator") or a brand or retailer partnered with Collective Voice ("Brand"), the processing of your information may be subject to additional terms in our commercial agreements with you.

Collective Voice is part of the Rakuten Group, which includes the affiliates and subsidiaries of our parent company Rakuten Group, Inc., based in Tokyo, Japan.

1. COLLECTION OF INFORMATION

Sources of Collection

We collect, process, and use information about you when you:

  • Register for our Program
  • Interact with our Program
  • Install and/or access our Program through our application(s), including our mobile application and browser extension
  • Connect to our Program with third parties, including social media platforms
  • Contact us for support
  • Enter a sweepstakes, contest, or promotion, or respond to a survey or poll

We collect certain information when you submit or provide it to us directly, such as via web forms, registration for the Program, or interactions with our support team. When you install our mobile application or browser extension or when you interact with our Program online, we also collect information about you and your use of the Program through the use of log processes, cookies, location- identifying technologies, and other tracking technologies, subject to your consent where applicable. Certain information is collected about you from third parties, including when you connect to our Program via a third-party service or authorization framework. When you log in with Google, our use and transfer to any other application of information received from Google APIs will comply with Google API Services User Data Policy found here https://developers.google.com/terms/api-services-user-data-policy, including the "Limited Use" requirements for specific API scopes as stated therein, and the Google API Terms of Service here: https://developers.google.com/terms.

Personal information we collect includes:

• Personal identifiers, such as your username and password for accessing your account, first and last name, your business address, your business email address, your business phone number;

• Online identifiers, unique online or device identifiers, IP address, device or session IDs and information regarding your system configuration (operating system and version), network, and connected hardware (e.g., computer or mobile device and carrier).

• Internet and other network activity, such as browsing history and your interactions with our Program, including, URLs of pages you visit, date and time stamps associated with such browsing and clicks, and click stream data, meaning the page-by-page clicks that you make as you navigate through our Program, including the web page visited before you navigated to our Program.

• Creator Record Information, such as Creator PayPal email address, taxpayer information, account balances, agent of record, payment and commission history. We will also collect and maintain Creator campaign record information, such as brands that Creator has worked with, fulfilment data, earnings information.

• Demographic Information, such as Creator race or ethnicity, only to the extent a Creator chooses to provide this information to us for the creator's own promotional purposes or in connection with diversity and inclusion programs that Collective Voice makes available. Creators may also choose to share areas of interest and expertise and their general location.

• Creator Content and Metrics, if a Creator submits content through the Program and/or connects their social media account(s) to our Program, we may receive additional personal information about the Creator. This information includes any personal information in the content itself and information that we receive from the social media platform, including Creator's social media handle, name, location, and follower count. The data we receive from the social media platforms may vary depending on the Creator's settings within the social media platforms and the features Creator elects to enable in the Program. We also collect data about the performance of the content that Creators submit through us and through the connected social media accounts, such as impressions, views, clicks, and similar information. If you enable certain Program functions or tools, such as Shop the Look, we may also request access to comments and messaging functionality in order to send links, such as those associated with the item in a post.

2. USE OF INFORMATION WE COLLECT

We use information we collect from or about you in the following ways:

To Administer the Program, including:

  • To process Creator registration into the Program, including verifying eligibility and enrolling Creators into our Program;
  • To manage Creator accounts, including tracking affiliate transactions, facilitating payment, surfacing preferred and best performing brands and products;
  • To send technical notices, updates, security alerts, and administrative messages; and
  • To provide support regarding your Program account and reply to your questions, comments, and requests.

To Improve the Program
We may also use information we collect about you to identify usage trends and perform statistical analyses to improve the overall Program and marketing efforts.

To Provide You Marketing and Advertising
We may use information provided by you to send you marketing via email and other direct communications, and through digital advertising. We may use your contact information to directly send you email newsletters, events, and general information about the Program. You can opt-out of or manage these direct marketing communications as provided in Section 4 (Your Privacy Rights) below. We may use Internet and other network information to advertise to you online, including targeted advertising, unless you are located in the EU, the UK, California, Colorado, Connecticut, Utah, Virginia, Texas, Oregon, Iowa, Delaware, New Hampshire, Nebraska, or New Jersey. If you are located in the above-listed U.S. states, we do not share or sell Personal Information about you for purposes of targeted advertising.

To Protect You, Others, and our Business
We may use collected information to assess risk and to investigate and limit fraud, spam, and other malicious online activities in our Program, and to improve our security measures. We may also use collected information to assert our legal rights or to defend our legal rights against third parties

To Comply With Applicable Laws
We may use information we collect about you to enable us to comply with applicable laws, rules, regulations, and judicial authorities in each geographical region in which we operate.

To Administer Contests, Sweepstakes, Surveys, Polls, and Promotions
From time to time, we may invite you to enter various contests, sweepstakes, surveys, polls, and promotions. If you choose to participate in a contest or promotion, your personal information may be used to administer the contest, such as to determine your eligibility for the contest or to award a prize.
To the extent we collect any sensitive personal information that is not publicly available, we do not process such information for the purpose of inferring characteristics about you, and, in any event, we do not use or disclose such information for any purpose other than: (1) to perform the services or provide the goods you request; (2) to prevent, detect, and investigate security incidents; (3) to resist malicious, deceptive, fraudulent, or illegal actions and to prosecute those responsible for those actions; (4) to ensure the physical safety of persons; (5) for short-term, transient use; (6) for operational tasks; or (7) to verify or maintain the quality or safety of a service we own or control.

Disclosure to our Service Providers
We may share all categories of your collected personal information as necessary with our third-party service providers who perform various business operations, solely for our benefit or on our behalf. We enter into written agreements with these parties that require these parties to, among other things, limit their use and disclosure of personal information to the specified business purposes and implement appropriate security safeguards.

Disclosure to Brand Partners and Affiliate Networks
Brands and Affiliate Networks will receive information about Creators as a referrer to their products through the Program. We may also share information about Creators for potential gifting purposes to Brands, as approved by Creators. For purposes of campaign casting, we may share certain information with Brands about Creator campaign preferences and Creator Content and Metrics

Disclosure to Digital Advertising Providers
To provide us with advertising and marketing services, we partner with certain third parties that use cookies, pixels and other tracking mechanisms to collect certain identifier information and internet and network activity information about your use of the Program, such as your browsing history, IP address, pages viewed, and links clicked, so that they can use this information on our behalf to serve you ads for our Program on other sites. These third parties may also use this collected information for their own business purposes and in relation to their other clients, governed by their own terms and privacy policy. You have particular opt-in or opt-out rights regarding the collection, use, and sharing of your personal information for cross-context behavioral advertising or targeted advertising, depending on the data protection laws applicable to you. Disclosure for Legal Purposes
We may share the information we collect, including personal information, to the extent required or permitted by applicable law, (i) in response to subpoenas or other legal or regulatory processes; (ii) at the request of governmental authorities conducting an investigation; (iii) to defend against claims or actions or to enforce our terms and conditions or other policies applicable to our Program; and (iv) to protect the rights, property, life, health, security and safety of Company or any third party.

In Relation to Business Asset Transfers
We may share the information we collect, including personal information, with any third party in connection with, or during confidential negotiations of, any proposed or actual merger, purchase, sale (including a liquidation, realization, foreclosure or repossession) or any other type of acquisition of all or any portion of Company assets, conveyance or transfer of all or a portion of our business to another company. In such event, the acquiring company would be contractually required to use your collected information in accordance with this Privacy Policy and applicable law or to provide prior notice to you of any new or materially changed practices.

We work closely with our affiliate businesses and companies within the Rakuten Group and disclose certain personal information for Rakuten Group internal corporate administration.

In certain jurisdictions, consumers or individuals have rights to know about the personal information we process, and to access, correct, delete, and object to, limit, or opt- out of the sale, sharing, or other processing of personal information (such as for targeted advertising), or in some cases obtain a list of specific third parties to whom we disclosed your information), or to engage an agent to exercise these rights on your behalf, as well as a right not to be discriminated against for exercising your privacy rights and to complain to the authorities in the event your privacy rights are not respected. We will not discriminate or retaliate against you for exercising any of the rights above. Note that in some jurisdictions, these rights do not apply to individuals acting in the capacity of a business or commercial relationship with us.

We may retain information about you for as long as it is necessary to fulfill the purposes described in Section 2. Some of your information may be retained in our systems even after you request your information to be deleted if a legal exception applies or to the extent it is necessary in order to comply with our obligations under applicable law, resolve disputes, enforce our legal rights, maintain security, integrity, and functionality, and undertake investigations necessitated by any of the forgoing, and for any solely internal uses that are reasonably aligned with your reasonable expectations and compatible with the context in which the information was collected.
